Agreement
By installing, activating, or using PhotoCheckWP, you agree to these Terms of Service. If you do not agree, do not use the plugin.
The Service
PhotoCheckWP is a WordPress plugin that intercepts image uploads to the WordPress media library, performs a reverse image search against the Google Cloud Vision Web Detection API, and surfaces potential copyright matches to the editor before the image is inserted into content. Every upload is logged with an audit trail.
PhotoCheckWP is a software tool. It is not a legal service, a copyright clearance service, or a substitute for legal advice.
License
PhotoCheckWP, LLC grants you a limited, non-exclusive, non-transferable license to install and use PhotoCheckWP on the number of WordPress installations covered by your active subscription plan. This license is valid only while your subscription is active.
You may not:
- Redistribute, resell, or sublicense PhotoCheckWP to third parties
- Modify, decompile, or reverse engineer the plugin code
- Use PhotoCheckWP on more sites than your subscription permits
- Share your license key with users outside your organization
Subscription and Payment
PhotoCheckWP is sold as a monthly or annual subscription through Freemius. Pricing is as listed on photocheckwp.com at the time of purchase. All payments are processed by Freemius. Payment terms, refund policies, and billing cycle management are governed by Freemius terms and your subscription agreement.
Subscriptions renew automatically unless cancelled before the renewal date. You are responsible for cancelling your subscription before renewal if you do not wish to continue.
API Costs
PhotoCheckWP requires a Google Cloud Vision API key, which you obtain and manage independently. API usage costs are billed directly by Google to your Google Cloud account. PhotoCheckWP, LLC has no visibility into, responsibility for, or control over your Google Cloud API usage or costs.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PHOTOCHECKWP, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF PHOTOCHECKWP, INCLUDING BUT NOT LIMITED TO:
- Copyright enforcement actions, settlements, or judgments against you or your organization
- Failure of the plugin to detect unlicensed or infringing images
- Data loss, site downtime, or plugin conflicts
- Actions taken or not taken by your editorial staff in reliance on plugin output
IN NO EVENT SHALL PHOTOCHECKWP, LLC’S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR PHOTOCHECKWP IN THE TWELVE MONTHS PRECEDING THE CLAIM.
No Warranty
PHOTOCHECKWP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. PHOTOCHECKWP, LLC DOES NOT WARRANT THAT THE PLUGIN WILL DETECT ALL UNLICENSED OR INFRINGING IMAGES, THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PARTICULAR IMAGE WILL OR WILL NOT RETURN MATCHES.
Indemnification
You agree to indemnify and hold harmless PhotoCheckWP, LLC and its officers, employees, and agents from any claims, damages, or expenses arising from your use of PhotoCheckWP, your violation of these Terms, or your violation of any third-party rights including copyright.
Termination
PhotoCheckWP, LLC reserves the right to terminate your license for violation of these Terms. Upon termination, you must cease using PhotoCheckWP and remove it from all installations.
Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Elkhart County, Indiana.
Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of PhotoCheckWP after changes are posted constitutes acceptance of the updated Terms.
